Signer eNotary Terms of Use

These Signer eNotary Terms of Use is between DocuSign, Inc. (“DocuSign”) and the person agreeing to these terms (“You” or “Your”). By either clicking a box indicating Your acceptance or otherwise using DocuSign Signature application for notarial services, You agree to the terms of these Signer eNotary Terms of Use (“Signer eNotary Terms”). If You do not agree to these Signer eNotary Terms, You may not use the DocuSign services for electronic notarization. You acknowledge that, although electronic notarizations may be accepted in certain states generally, certain counties, cities, agencies, entities, businesses etc., may not accept electronically notarized documents. You are responsible for confirming acceptance of electronically notarized documents prior to using DocuSign services for electronic notarization. You further acknowledge that notaries using the DocuSign electronic notarization service are not employees, representatives, or agents of DocuSign, Inc. or its affiliates and that all electronic notarizations using DocuSign services are accepted, modified, and completed at the sole discretion of such notaries. DOCUSIGN MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND REGARDING THE EFFECTIVENESS OR VALIDITY OF ANY ELECTRONICALLY NOTARIZED DOCUMENT OR REGARDING THE TRANSACTIONS SOUGHT TO BE EFFECTED BY ANY DOCUMENT. If there is an existing agreement between You and DocuSign (“Agreement”), then, in the event of any inconsistency or conflict between these Signer eNotary Terms and the Agreement, these Signer enotary Terms shall control with respect to electronic notarization services.
