<p>One of our customers, <a href="http://www.bloodhoundrealty.com/BloodhoundBlog/?p=9915">Greg Swann of the BloodhoundBlog</a>, recently blogged about his short sales experience, in which the bank asked for two URGENT documents that reiterated the terms his buyers have already agreed to.</p>
<p>With Mom at home, Dad at work and Greg 35 miles from both of them, how was he going to get the documents the bank wanted ASAP?</p>
<p>By trading faxes with barely legible originals? NO.</p>
<p>Instead, Greg used DocuSign to set up a workflow in which he signs, Mom signs and Dad signs before the lister receives the completed document package.</p>

<p>Some key points from the <a href="http://www.twitter.com/DocuSign">DocuSign twitter</a> stream from Ken Moyle&#8217;s discussion about the &#8220;Legality of Electronic Signatures and Real Estate&#8221;</p>
<ul>
<li>E-signature is fully supported in CA and there is no California case law that questions the legality of electronic records or signature.</li>
<li>Fannie and Freddie do not have problems with electronic signature.</li>
<li><a href="http://www.docusign.com/real_estate/">DocuSign is set up for real estate</a> transactions</li>
<li>Ken discussed value and features for electronic signature and electronic evidence &#8211; <a href="http://www.docusign.com/products/security_and_performance/index.php">DocuSign does have these electronic evidence features</a>.</li>
<li>DocuSign&#8217;s optional initial feature came up, which allows signers to pick and choose which provisions they agree to &#8211; our <a href="http://twitter.com/berkhills/statuses/4665828670">users love this</a> and <a href="http://twitter.com/aaronwheeler/statuses/4665788054">leverage it</a> for optional clauses like liquidated damages and others.</li>
<li>Ken showed a demo video of the DocuSign electronic signature signing experience, to demonstrate its look and feel. The signing experience includes adoption of a signature, consumer disclosures which enable DocuSign electronic signature to be ESIGN compliant.</li>
<li>Fraud mitigation was a topic of discussion &#8211; DocuSign provides access codes and ID check functionality and lots of tools in place to mitigate fraud.</li>
<li>Ken Moyle called us all super, super heroes, but we can&#8217;t prevent all crime. However, it is hard for people to use DocuSign for fraud and not get caught.</li>
<li>Lots of great questions were asked about electronic signature, including where tablet PCs fit into electronic signature or digital signature space.</li>
</ul>

Whats Really Going on?" width="186" height="182" /></a>Since DocuSign began participating in online conversations about electronic signatures and online contract execution, we&#8217;ve noticed that misperceptions exist regarding whether or not various groups approved the use of digital signature and electronic contracts or records. We recently published a piece discussing <a href="http://www.docusign.com/blog/2009/06/11/fha-lender-acceptance/">FHA and lender acceptance of electronic signature</a>, and we also heard rumors that PAR, the Pennsylvania Association of REALTORS®, had not approved electronic signatures for contracts.</p>
<p>For clarification, we asked <a href="http://www.parealtor.org/content/">PAR</a> to share their thoughts on electronic signatures, and Hank Lerner, Director of Member and Legal Services responded promptly (from his email):</p>
<blockquote><p>The federal E-SIGN statute and PA Electronic Transactions Act (<a href="http://www.parealtor.org/content/Laws_Regulations.htm">http://www.parealtor.org/content/Laws_Regulations.htm</a> ) both state that electronic signatures are acceptable in transactions as long as they are done in compliance with the requirements of the laws.  <strong><em>PAR&#8217;s &#8220;position,&#8221; as it were, is simply that if an electronic signature is done in compliance with the law, then it is legally binding</em></strong><em>. </em>We have not ever suggested that our members cannot or should utilize e-signatures in their business; a decision to do so or to not do so is up to the individual brokers or agents. (emphasis ours)</p></blockquote>
<p>PAR also stated that it does license the content of its statewide standard forms to four electronic forms vendors, all of which have relationships with DocuSign, to provide e-signature capabilities directly from the applications.</p>
<p>Ken Moyle, DocuSign&#8217;s Chief Legal Officer and the rest of the management team designed DocuSign so that the DocuSign system is in compliance with the law. DocuSign&#8217;s security measures ensure that your records and data are fully secure. As of this date, in every case that a DocuSign electronic signature or contract has been challenged, the evidence and digital trail created by the DocuSign system has resulted in party backing down from their attempted repudiation.</p>

Haven’t some ESIGN tools been around for a long time? Why now?” These great questions have two sets of answers. The first is <strong>Why NOW</strong><strong>?</strong>, the second is <strong>Why DocuSign?</strong> <strong>The answer to ‘Why Now’ for Real Estate</strong> The main answers to <strong>‘why now?’</strong> are risk and the fact we are all on the same wire. When we first started providing ESIGN to the Real Estate market in 2004, it was just too early. Realtors were still getting introduced to web sites as marketing vehicles, and using the web to move valuable data and documents was still on the edge of being risky. Now, with huge multi-national companies such as Fidelity, Comcast, John Hancock, Monsanto, Microsoft, Cisco, and many others executing millions of esign contracts each month, the time has arrived. These large companies signal that the technology and legal frameworks are in place: <em> In short, ‘it is safe and OK to ESIGN rather than fax’.</em> <em></em>The other answer is really timing – we are literally all on the <span><em><span style="text-decoration: underline;"><span style="font-size: small;">same wire</span></span></em></span><a name="_ftnref1"></a><a href="http://docs.google.com/Edit?docid=ddd43wfw_92hmvzshdt#_ftn1">[1]</a> milliseconds away from each other. Why not take advantage of this fact and send you documents to sign securely, rather than forcing things back off the ‘wire’, and into a fax machine into paper. We KNOW it is better to stay online now. <strong>The answer to ‘Why DocuSign’ for Real Estate</strong> This answer has to do with years of iteration with our Realtor customers as much as anything else! We’ve been partnering with leading Real Estate forms vendors and other technology providers as well as hearing feedback from Realtors longer than anyone else. NAR’s forms technology arm adopted DocuSign as its standard years ago. We learned that a tool to execute contracts for Real Estate transactions needed to be powerful AND easy to use. Vital Capabilities:</p>
<ol>
<li><strong>“Make it easy and familiar for my signer &#8211; I am trying to close a deal, not train them on technology or law.”</strong> – DocuSign is the only system that uses the familiar yellow ‘sign here’ and ‘initial here’ tabs. As part of our patented process, these signature indicators are really familiar and our ‘one-click’ signing makes it both legally binding and simple to use. My signatures, initials, and data need to be exactly placed, without odd ‘borders’ or ‘seals’ appearing in strange places. Downstream these will always get kicked back.</li>
<li><strong>“Help me handle complex transactions”</strong> – Often the Real Estate transaction has a number of forms to fill out, initial and sign. DocuSign’s system can automatically recognize your documents and apply templates so you get the benefit of exact signature placement without having to do all the work!</li>
<li><strong>“Integrate into my forms software” </strong>– By integrating directly into the software Realtors use to create and manage forms, DocuSign makes sending for signature a ‘one click process’. Talk about saving time!</li>
<li><strong>“Allow me to sequence my documents to specific roles” </strong>– such as buyer &amp; seller, and allow me to easily follow the industry standard practice.</li>
</ol>
<p>So, these key points make DocuSign the clear leader for the Real Estate market. These and many other reasons explain why so many Realtors blog about DocuSign, tell their customers about DocuSign, and why the word ‘DocuSign’ is being used as a verb for electronic signature and online contract execution! You’ve probably heard it at conferences – you know <em>“Hold on, I need to get my buyer to DocuSign it so I can close this deal”.</em> <a href="http://docs.google.com/Edit?docid=ddd43wfw_92hmvzshdt#_ftnref1">[1]</a><span><em><span style="font-size: small;"> The same ‘wire’ – the INTERNET, silly!</span></em></span> <a href="http://docs.google.com/Edit?docid=ddd43wfw_92hmvzshdt#_ftnref2">[2]</a> <span><em><span style="font-size: x-small;">Like<a href="http://docusign.com/blog/2009/06/15/signing-using-a-mouse-the-worst-of-both-worlds/"> ‘mouse cursive’</a></span></em></span><span><em><span style="font-size: x-small;"> – ever try signing your name with a mouse? It is just silly. Nobody can – everyone hates it. </span></em></span><span><em><span style="font-size: x-small;"> Amazing waste of time that shows lack of understanding of what signing really is.</span></em></span></p>

<div><span style="color: #3366ff;">I&#8217;m a simple man from South East Michigan&#8230;I was born and raised in SE Michigan. Graduated from the University of Michigan.  Prior to real estate, I had a diverse job experience: automotive market research, governmental affairs division in a trade association, communications analyst and political campaign manager.</span>HA!  Real Estate Simplified with Black Tie Service was my first crack at a slogan in my young real estate career.  Simply put, my service to my clients is &#8220;black tie.&#8221;  In fact, I still show up to my closings in a tux!  Folks around Ann Arbor have taken to calling me <a title="Todd Waller on Twitter" href="http://www.twitter.com/toddwaller" target="_blank">Black Tie Todd</a>.</p>
<p>Real Estate @ the Speed of Life is the slogan for my real estate team, <a title="Team366 Blog" href="http://blog.team366.net/" target="_blank">Team366</a>.  My business partner and I assembled a team of agents with the intent of being accustomed and competent with the latest technology for real estate, but able to communicate effectively and at the pace of our clients.  If they want to run like the wind to buy or sell a home, we can do that!</p>

<div><span style="color: #3366ff;">I CAN NOT LIVE WITHOUT MY BLACKBERRY!  Hands down, it is a business machine.  When you predicate your business plan on responsiveness and efficiency, nothing beats a blackberry for instant email and communication.  Past that one piece of hardware, I would also need to mention two pieces of software or services:  Google Apps for my Domain and DocuSign (not trying to kiss up, but DS is THAT important to my business!)</span>Google apps simply because it is too easy to set up, fill and organize all the digital stuff of my business.  <a title="DocuSign Real Estate Page" href="http://www.docusign.com/real_estate/index.php" target="_blank">DocuSign</a>, because I can send my contracts anywhere for signatures and because it has saved me countless hours of cross town travel and from headaches trying to decipher a multi-faxed document.</p>

<p>How did you discover DocuSign and do you know others who use technology tools like DocuSign in your area?</p></div>

<div><span style="color: #3366ff;">Oddly enough, I ran into <a href="http://www.docusign.com/" target="_blank">DocuSign</a> about the same time a real estate attorney approached me about it.  He suggested that me and my team look into it as he felt we were the only ones in the market place who could see its immediate value and need. </span> </p>

<p>There are many people that use DocuSign in many different ways, like using the consistent, personalized branding, bulk sending or multiple signers functionality or using the API to integrate with existing programs like Salesforce. How do you get the most out of DocuSign and what has been your most extraordinary DocuSign moment?</p></div>

<div><span style="color: #3366ff;">We&#8217;re not even that fancy with our implementation of DocuSign!  We use the web interface and the <a href="http://www.docusign.com/devcenter" target="_blank">API</a> between an online RE form generator and DocuSign.</span>The Ah Ha! moment for me was last summer.  I had shown my buyers a few homes that day and knew they were &#8220;thinking hard&#8221; about one of the homes.  They expressed to me that they would get back with me the next morning to let me know what their decision would be.  They called just a few hours later and stated that they wanted to put an offer in on that one home.  Long story short, I could not meet with them in person, but I could write the offer, get their signatures and initials via DocuSign and, in conjunction with my BlackBerry, email the offer into the listing agent.</p>
<p>Good thing we had <a href="http://www.docusign.com/solutions/" target="_blank">DocuSign</a> to overcome our scheduling difficulties;  we got the offer to the sellers, and had their signatures before two other offers could be produced.</p>

<div><span style="color: #3366ff;">I am a firm believer that all the cool technology that is coming out, <a title="DocuSign Product Page" href="http://www.docusign.com/products/" target="_blank">DocuSign</a> included, is simply making the job of the real estate agent</a> more efficient.  My job is to communicate effectively and efficiently with my clients, providing them the answers they deserve and crave.  Ultimately, I see the job of real estate agent include the ability to find and wrangle information on behalf of our clients</span>. </div>
